*** THE FOLLOWING DOES NOT APPLY TO MISDEMEANORS AND/OR FELONY OFFENSES - IF YOU ARE CHARGED WITH ANY MISDEMEANOR AND/OR FELONY OFFENSES, YOU MUST APPEAR IN COURT ON THE DATE AND TIME STATED ON YOUR TICKET AND/OR APPEARNCE NOTICE***
If you have been issued a Vehicle and Traffic Ticket, you must enter a plea of guilty or not guilty, sign and return the ticket to the court. The instructions for entering a plea of guilty or not guilty are located on the front of the ticket. The Court Clerk must receive your plea prior to the court date stated on the ticket. Your failure to submit your plea prior to the scheduled Court date or to appear in person on the scheduled Court date and time may result in the suspension of your driving privileges.
If you submit a plea of guilty: The Court will mail you a letter notifying you of the sentencing, including any fine(s) and applicable New York State surcharge(s). You should receive this letter withing 3-4 weeks from the date you mail it in. Your failure to remit payment on or before the due date set forth in the letter may result in the suspension of your driving privileges.
If you submit a plea of not guilty: The Court will mail you a letter notifying you of the scheduled Pre-Trial Conference date and time. You should receive this letter within 2-3 weeks from the date you mail it in. Your failure to appear on your scheduled Court date and time may result in the suspension of your driving privileges.
** In an attempt to handle Vehicle and Traffic plea bargains expeditiously and safely, the Town Prosecutor is reviewing all tickets and may make a plea bargain offer to a defendant. You must first submit your plea to the court. The court will then schedule the matter for a Pre-Trial Conference and send you notification of the date via mail. You may then receive a letter from the Town Prosecutor with a possible resolution to your violation. You may either accept the offer or decline the offer and ask for a Trial date, or appear in Court on your currently scheduled Pre-Trial Conference date to meet with the Town Prosecutor in-person. YOU MUST RETURN THE PROPOSED OFFER ON OR BEFORE YOUR SCHEDULED APPEARANCE DATE. If you have hired an attorney, and your attorney has submitted a plea on your behalf along with a Notice of Appearance and a Waiver to the Court, the Town Prosecutor will submit any plea offers directly to your attorney. **
